The Case: Korean Mohammed, Anissa Alimuddin, and Christian Pulchan v. Timothy C. Lockett & Extech Building Materials, Inc.

On April 6, 2019, our client, Korean Mohammed, a 44-year-old home health aide, was driving in Newark on the Route 1/9 exit ramp near Wilson Avenue. She had two passengers in her vehicle, Anissa Alimuddin and Christian Pulchan.

Mohammed stopped for a red light, and the driver of a truck hit the left rear of her stopped car. Our client suffered injuries to her neck and shoulders. Her passengers also suffered injuries but settled their claims separately.

Our firm filed a lawsuit against the truck driver and the owner of the truck. We alleged that the truck driver drove negligently and rear-ended our client as a result. Further, the truck owner was vicariously liable for the driver’s negligence.

The two passengers settled their cases, and the defendants admitted liability. The case proceeded on the matter of how much in damages our client should receive.

Injuries and Damages

Mohammed suffered significant injuries as a result of the rear-end crash. She was treated and released from a hospital immediately following the collision. Subsequent medical evaluations identified:

  • Herniations of her C3-4, C4-5, C5-6, and C6-7 intervertebral discs
  • Rotator cuff tears in her right shoulder
  • SLAP tears in her right shoulder
  • Impingement of the right shoulder
  • Partial labrum and rotator cuff tears in her left shoulder

To address her injuries, Mohammed underwent a series of treatments, including chiropractic care, physical therapy, and cervical epidural injections. She also underwent multiple surgeries, including arthroscopic procedures on her right and left shoulders, as well as cervical disc fusions.

Mohammed continues to require ongoing medical care, and may potentially need another neck fusion in the future. These injuries have significantly impacted Mohammed’s daily life, making simple tasks such as showering, getting dressed, cooking, and caring for her child very challenging. She lost an estimated $747,003 to $869,158 in past and future income from not being able to work.

On the other hand, the defense suggested some injuries were not crash-related, and that she could still perform some work, estimating her lost income at only $48,000.

The Settlement

After extensive negotiations, the parties reached a pretrial settlement of a total of $2.5 million. This includes $688,538.62 from the defendants’ primary insurer and an additional $1,811,461.38 from the defendants’ excess insurer. The total settlement provides compensation for Mohammed’s past and future medical expenses, lost wages, and damages for her pain and suffering.
