Joseph Stimmel Secures $2.25 Million Dollar Jury Verdict

On February 18, 2025, following a two-week jury trial in New York City, Joseph Stimmel of Varcadipane & Pinnisi, P.C. secured a $2.25 million dollar verdict in favor of the Firm’s clients who sustained injuries as a result of a trip and fall accident. The Firm’s client suffered a traumatic brain injury and chronic, post-concussion syndrome because of the accident, which significantly reduced his cognitive abilities, affected his daily living, and prevented him from returning to work. His wife also asserted a claim for loss of services and companionship as a result of her husband’s injuries and limitations.

The property owner defendant and its insurer refused to make a settlement offer throughout the lawsuit, labeling the case a “no-pay”, and during the trial, the defense only made a nominal $50,000 offer. At the close of the two-week trial, Mr. Stimmel not only won a unanimous $2.25 million dollar jury verdict against the property owner, but the jury also refused to assign any comparative fault to the Firm’s client who the property owner attempted to blame throughout the trial.
